Students, H-1B, L-1 visa holders, and certain other visas can adjust their immigration status simultaneously with an EB-5 application. The Adjustment of Status petition allows applicants to remain in the United States and apply for a work permit while awaiting their Green Card through the EB-5.
The processing of the Employment Authorization Document (also known as the “EAD Card”) by USCIS seems to be going expeditiously. At least one of the investors in our Brooklyn Basin Phase 2 project who completed the concurrent filing process, received his work permit in under three months.
Our EB-5 investor client shared his experience in a conversation with us:
Q: What made the U.S. an attractive country for you to live in?
A: Educational system, diverse breadth of opportunities.
Q: Why did you decide on the EB-5?
A: As a finance professional working in the United States, I have found that the F-1/H-1B work visa can be limiting in terms of opportunities. Fortunately, the EB-5 visa provides a streamlined process for obtaining long-term residency and more freedom to pursue professional opportunities.
Q: How has been your process so far?
A: My experience with Golden Gate Global has been great. After considering several projects, I ultimately chose GGG due to its long track record and informative conversations with its team. My EB-5 application was submitted in September, and I have already received my EAD card through concurrent adjustment.
Q: Why did you select Golden Gate Global´s project?
A: I was impressed by its strong track record and I also had the opportunity to visit the project site, which solidified my decision to invest with them.
Q: How did you like the “concurrent filing” which is new in the EB-5 reform and applies to your case?
A: As I was already in the country on an F-1 visa, I was able to take advantage of concurrent filing and obtain my EAD and travel card while my EB-5 application is being reviewed by USCIS.
Q: Something you would like to share with potential investors who remain hesitant and can benefit from the concurrent filing?
The recent change in the EB-5 policy in relation to the concurrent filing has been pivotal in our investment decision. As someone who previously worked under F-1 OPT visa with limited EAD restrictions, I found the EB-5 visa to be a smart choice for pursuing long-term prospects in the United States. With concurrent filing, I was able to receive my EAD card within a quick timeframe of 3-4 months from submitting my application.
